1. Scope and Purpose

a. a. My.HANSA-FLEX is the customer portal of HANSA-FLEX AG, Zum Panrepel, 28307 Bremen ("HANSA-FLEX"). The X-CODE Manager is an application for planning, managing and documenting operational safety tests of hose assemblies and other hydraulic components. If you (as an employee or external service provider) have been commissioned by a company to use My.HANSA-FLEX or the X-CODE Manager, you can use the browser-based web application of the X-CODE Manager or the mobile application (together hereinafter also referred to as the "Application") for this purpose. The mobile application is offered for download free of charge by the app store ("Platform") of the respective operator ("Platform Operator"). The contractual partner for the use of the application as well as the use of its contents is HANSA-FLEX, not the platform operator. These Terms of Use apply both to the use of the browser-based web application and to the mobile application.

b. The purpose of the application is to plan, manage and document operational safety inspections of components of hydraulic line technology. This is intended to comply with legally prescribed maintenance intervals and to avoid unscheduled machine downtimes and component wear.

c. Use of the application is permitted exclusively on the basis of these terms of use. Any general terms and conditions or other contractual conditions of yours shall not apply.

d. The Application is not directed to consumers. You may only use the Application if you are doing so on behalf of a business. Use for private purposes is not permitted.

2. Registration

a. If you have been authorised to use the application by a HANSA-FLEX customer, you will receive an e-mail from HANSA-FLEX with a link to the browser-based web application of the X-CODE Manager. There you can log in for the first time and create a password.

b. You can only complete the registration if you accept the terms of use.

c. You may not pass on your access data to third parties.

3. Rights of Use

a. HANSA-FLEX grants you the geographically unlimited, non-exclusive, non-transferable right to use the respective current version of the Application as intended and in accordance with these Terms of Use.

b. You may only use the Application to perform your contractual duties for the HANSA-FLEX customer.

c. Notwithstanding the rights of use granted under this clause, HANSA-FLEX shall retain all rights to the Application. This includes in particular all versions of the Application including updates and upgrades.

4. Unauthorised Use

a. You may not make the application available to third parties, whether in return for payment or free of charge.

b. You may not do the following:

• Duplications of the App that are not necessary for the intended use;
• Editing, translating, reverse engineering or otherwise interfering with the App;
• Decompiling, disassembling or taking any other action to obtain the source code of the App;
• Removing or modifying product labels or copyright notices.

5. Changes to the Terms of Use and the Scope of Functions

a. HANSA-FLEX reserves the right to change the Terms of Use in a manner that is reasonable for you and only with effect for the future. You will be expressly notified of any changes to the Terms of Use via the application. The current version of the Terms of Use shall always apply to you.

b. Furthermore, HANSA-FLEX reserves the right, at its own discretion, to extend or shorten the scope of services of the application at any time, to change functionalities or to discontinue the offer. This is because the rapid development of the Internet in particular makes it necessary for HANSA-FLEX to make adjustments to the application in terms of technology and content from time to time.
